Section 7 – Acknowledgement of Terms
I understand that, in order to participate in the program, the participant must enter into a Public Infrastructure Incentive Program Agreement with the City of Mesa (“Program Agreement”) within 30 days of notice of award or the City of Mesa may revoke the award. If the property owner is not the participant, the property owner shall also be required to execute the Program Agreement with the City.
I understand that the participant shall be required to provide reporting information to the City of Mesa following completion of the Project, including but not limited to, jobs created and/or retained and capital improvements associated with participation in the Public Infrastructure Incentive Program. Failure to comply with reporting requirements or the terms of the Program Agreement may result in default under the Program Agreement and may require repayment of funds or termination of assistance.
I understand that the Public Infrastructure Incentive Program includes two funding pathways. Tier 1 (projects with estimated costs of $50,000 or less) which is intended for smaller infrastructure improvements and provides a streamlined review and agreement process. Tier 2 (projects with estimated costs exceeding $50,000) is intended for larger or more complex projects and may require additional review and execution of a Development Agreement with the City.
I understand that I will be informed of the estimated project cost based on the utility scope of work before work begins. If the estimated project cost exceeds $50,000, but does not exceed $75,000, I may have the option to contribute the amount above $50,000, up to a maximum participant contribution of $25,000, in order to remain within the Tier 1 process. Projects with estimated costs greater than $75,000 will proceed through the Tier 2 review and agreement process.
I understand that the participant and property owner are required to work collaboratively with the City of Mesa throughout the Project and must respond in a timely manner to requests for information, documentation, coordination, or agreements in order to participate in the Public Infrastructure Incentive Program.
WITH AN APPLICATION FOR ANY BENEFIT OR PRIVILEGE (A.R.S. § 13-2704), SUCH AS THE PUBLIC INFRASTRUCTURE INCENTIVE PROGRAM, THE CITY OF MESA CONSIDERS THE INFORMATION ON THIS APPLICATION AND ANY DOCUMENTATION SUBMITTED RELATED TO THE PUBLIC INFRASTRUCTURE INCENTIVE PROGRAM TO BE MATERIAL TO PARTICIPATE IN THE PROGRAM.
PARTICIPANT CERTIFICATION: I certify and swear that the information on this form and the documentation submitted to the City of Mesa is accurate and complete to the best of my knowledge and belief. I understand that false statements or information may be punishable as a criminal offense, are grounds for denial of my application, and will entitle the City to seek reimbursement of any funds or other assistance provided under the Public Infrastructure Incentive Program.
I UNDERSTAND that submission of this application does not guarantee Public Infrastructure Incentive Program participation or the receipt of assistance of any kind. Program funds or assistance awarded will be at the City’s sole and absolute discretion based on eligibility and available funding. The city may require additional information or documentation for evaluation.
